Tamil Nadu’s ban on online gaming has been challenged by the E-Gaming Federation

  • By defining rummy and poker as games of chance, the E-Gaming Federation (EGF) will contest the Tamil Nadu government’s latest ordinance outlawing online gaming. The Indian Constitution’s Article 19(1)(g) protects rummy as largely a game of skill. It is a clear breach of the Supreme Court decision and the Madras High Court decision overturning the online gaming prohibition to include rummy as a form of gambling.

We have chosen to launch a case since rummy and poker are considered to be games of chance after carefully examining the rules. The Supreme Court and other Supreme Courts have acknowledged skill gaming as a legal industry, and states should take these opinions into consideration when creating gaming policies that protect players rather than enacting outright bans. This contradicts multiple court decisions.

The Supreme Court of Madras has ruled in the past that a game of skill and not gambling or a game of chance is any game (including rummy and poker) in which a person with more education wins. Further, the Supreme Court ruled that card games like rummy and poker do not distinguish between real-world and online/virtual talents.

What the online skill gaming industry and Tamil Nadu need now is a comprehensive online gambling policy that protects players and ensures that only legitimate online skill gaming operators are offering their services.

The Indian gambling market is expected to grow from $2.2 billion at present to $5 billion by 2025. The sector is growing at a CAGR of 38%, offering great potential for macroeconomic growth and employment. Furthermore, to unlock the future potential of the sector, the central government has set up an Inter-Ministerial Task Force (IMTF) and MeITY has consulted with all stakeholders on the regulation of the online gambling industry.
